What Are Car Accident Claims?

Being involved in a car accident can be a significantly damaging experience, psychologically, financially, and medically. You could lose your car after an accident or, worse, experience an injury to your body or mental health.

If you’re involved in a road collision, a car accident claim is what you can use to receive compensation for the medical and repair bills following the motor incident. In simpler terms, a car accident claim helps you recover everything you’ve lost due to the accident.

Who Can Claim CTP Insurance After a Car Accident in QLD?

Everyone involved in a car accident would like to recover their losses. However, not everyone is entitled to claim compensation following an incident. This is where legal assessment is crucial — a car accident lawyer will help you understand whether you are entitled to claim any compensation after the fact.

There are many aspects involved in determining whether you can claim compensation, including determining who was at fault, who incurred losses, and the strength of your claim. We can help you figure this out, whether you’re a driver, a passenger, a pedestrian, or even a cyclist. Our expert team will help you assess whether you may be entitled to claim compensation, particularly if you believe that the accident occurred due to no fault of your own.

How do You Claim from Insurance After an Accident in Queensland?

Car Accident Claims Queensland
How do You Claim from Insurance After a Car Accident in Queensland

Our team at WT Compensation Lawyers will walk you through every step of claiming your car accident compensation, from filling out the forms and lodging your claim to finally receiving your payout. Whether you’re just starting the claim process, or have completed a few of the steps already, we’re here to help.

Below, we’ve outlined the 6-step process for lodging motor vehicle accident claims in Queensland, according to the MAIC

1. Report the Incident to the Police: Reporting a car accident to the police is vital, as it provides the first legal documentation covering the incident. The police will also give you a reference number, which you’ll need to add to your police report. This initial report is essential for making a claim.

2. Meet Timeframes: There are strict timeframes for making a car accident claim in Queensland. Your claim must be filed within these timeframes, or it may be dismissed by the court.

3. Get Registration of Other Vehicles: Since a car accident involves more than one party, you must record information, like the registration number, of the opposing vehicle(s). You’ll also need the date of the crash and the name of the other driver(s) to complete your claim. If the vehicle cannot be identified, you can lodge a claim against the Nominal Defendant.

4. Complete a Notice of Accident Claim Form: When completing a car accident claim form, you must provide as much information about the incident as possible. We recommend submitting this form within one month of the accident.

5. Provide Supporting Documents: You should also gather any evidence regarding your medical and repair expenses, in order to quantify your claim. Bills and other documents proving your losses are essential.
6. Begin Court Proceedings: If the claim can’t be settled between you and the other party, and an agreement can’t be negotiated, you may need to institute litigation proceedings to receive what you believe you’re owed.

Even if at fault, you may have a right to compensation. Start your claims check:
