What is public liability claim?

The majority of Queensland businesses will have Public Liability insurance to cover people who get injured on
their premises and has one purpose – to help those who are injured.

This means that if you start a Public Liability claim, it is against an insurance company so the business will not personally be out of pocket.

How does it work?

After our free initial consultation where you’re made fully aware of all your rights and entitlements, we lodge a
Part 1 Notice of Claim with the insurer. We then work with you to formulate a strategy to maximise your claim.
The process then involves a number of steps including liability assessment, responding to complex requests for information from the insurer, medical assessment and negotiations.

We know the process can feel overwhelming, so we want you to simply focus on getting your life back on track and leave the rest up to us.

How is my compensation calculated?

The amount of compensation you may be entitled to depends on a variety of factors. This includes:

• The extent of your injuries
• Your age
• Your employment
• The impact on your wages
• What kind of treatment you will need now and in the future
• Whether you will require any care now and in the future.

Strict time limits apply for making Public Liability claims so get in touch for our free initial consultation so you can understand your rights.

Frequently asked questions

Unfortunately, we can’t tell you how much your claim is worth without first taking a look at your individual situation, employment and injuries. Unlike some other firms, we will not entice people to start claims by providing case studies of some clients receiving hundreds of thousands of dollars for certain injuries. Although that may happen in your claim, it is important for you to know that each case is different and a thorough look into every detail is required to tell you how much your claim is worth.

Each claim is different but the majority of whiplash claims can be settled in 12 to 14 months.

The length of your claim depends on how long it takes for your injuries to get better, so claims can vary in timeframes depending on how serious the injuries are. Regardless, we always do everything we can to settle claims as quickly as possible for our clients.

The vast majority of claims are settled without ever having to go to court. We are able to negotiate out-of-court settlements because it is usually in the best interests of the parties to settle. However, if your claim does need to proceed to court, don’t worry, we will fight by your side every step of the way.
